How to Start the Regulation No. 1102 Permitting Process

 

  1. The Air Quality Management Section encourages all applicants to meet with an air permitting engineer or scientist before submitting a final permit application.  This Draft Application Review Meeting ensures that the final application will be both administratively complete and technically complete.  To schedule a Draft Application Review Meeting, contact your assigned air permitting engineer or scientist.  If you do not have an assigned air permitting engineer or scientist, contact Joanna Austin at (302) 739-9402.

  2. Once you have scheduled your Draft Application Review Meeting, submit a draft application to your assigned permitting engineer or scientist.  Please note that the draft application should be submitted to your assigned permitting engineer or scientist 7 calendar days prior to your Draft Application Review Meeting.

  3. You may submit your final application at the close of your Draft Application Review Meeting if your assigned permitting engineer or scientist believes that your draft application is complete.  To submit a final application you must enclose the appropriate application fees.  Click here for a list of Air Quality Management Permit Fees.

  4. If your assigned engineer or scientist requests additional information at the Draft Application Review Meeting, you may submit your final application once you have collected the information.  To submit a final application you must include the appropriate application fees.  Click here for a list of Air Quality Management Permit Fees.

  5. Once a final application has been submitted, Air Quality Management will review the application for administrative completeness.
    1. Applicants who have submitted an administratively complete application will receive a letter stating that the application is complete.
    2. Applicants who have submitted an administratively incomplete application will be notified by telephone and/or e-mail that the application is not administratively complete.  The  notification will include the information required to make the application administratively complete.  If the required information is not received within 14 calendar days of the notification, a registered letter will be sent to the applicant requesting the required information.  If the required information is not submitted within 14 calendar days of the letter, the application will be returned to the applicant.

  6. Once a permit application is deemed administratively complete, it will be sent to the assigned permitting engineer or scientist for a technical completeness review.
    1. If the application is not technically complete, the applicant will receive a phone call and a follow-up e-mail from the assigned engineer or scientist to discuss the missing information.  The applicant will be given 14 calendar days to supply this information.
    2. If the missing information is not received within 14 calendar days, a registered letter will be sent to the applicant requesting the required information.  If the information is not received within 14 calendar days of the letter, the application will be returned to the applicant.

  7. Once a permit application has been deemed both administratively and technically complete, the assigned permitting engineer or scientist will begin processing the application.
