Title V is a federal program designed to standardize air quality permits and the permitting process for major sources of emissions across the country. The name "Title V" comes from Title V of the 1990 federal Clean Air Act Amendments which required that the U.S. Environmental Protection Agency (EPA) establish a national operating permit program. Accordingly, EPA adopted regulations [Title 40 of the Code of Federal Regulations, Chapter 1, Part 70 (Part 70)], which required states and local permitting authorities to develop and submit a federally enforceable operating permit programs for EPA approval. As a result, the State of Delaware developed Regulation No. 30 of the “Regulations Governing the Control of Air Pollution.”
Title V only applies to "major sources." EPA defines a major source as a facility that emits, or has the potential to emit (PTE) any criteria pollutant or hazardous air pollutant (HAP) at levels equal to or greater than the Major Source Thresholds (MST). The MST for criteria pollutants may vary depending on the attainment status (e.g. severe, serious, extreme) of the geographic area and the Criteria Pollutant or HAP in which the facility is located.
Title V also required that facilities subject to the program pay an annual fee sufficient to cover all reasonable direct and indirect costs associated with administering the Title V permit program. Within the State of Delaware, the fees are covered under 7 Del. Code §6095. These fees must be reviewed every three calendar years.
Purpose
This page provides information about development of the Title V Fee schedule for calendar years 2009 through 2011. It will contain meeting dates, times, and locations, as well as downloadable meeting agendas and handouts. Minutes from past meetings will also be posted. The page will remain active until legislation approving the 2009-2011 Title V Fee Schedule has been approved.

Background
The Air Quality Management Section (AQMS) Title V fee schedule is set to expire in calendar year 2009. As a result, the AQMS must develop a draft Title V fee schedule for CYs 2009-2011 to present to the Delaware Legislature for approval.
