NEWS UPDATES:

DNREC’S DART YARD WASTE SITE WILL CLOSE FOR MAINTENANCE AUGUST 31 – SEPTEMBER 9 - DNREC’s DART Mid-County Community Yard Waste Demonstration Site will temporarily close for maintenance activities beginning Monday, August 31 through Wednesday, September 9 and will reopen at 8:30 a.m.,  Thursday, September 10. PUBLIC HEARING REGARDING THE CONSENT DECREE FOR RESPONSE COSTS AND NATURAL RESOURCE DAMAGES FOR FOX POINT STATE PARK SITE (MODIFIED) - The Site Investigation and Restoration Branch (SIRB) has scheduled a public hearing regarding the Consent Decree for the settlement by New Castle County for response costs and natural resource damages for the Fox Point Park Site located in Wilmington. The public hearing will be held on Wednesday, September 16, 2009 at 6 p.m. in the library at Bellevue Hall, located at 911 Philadelphia Pike in Wilmington. BROWNFIELDS DEVELOPMENT PROGRAM The Division’s Brownfields Development Program encourages the cleanup and redevelopment of vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a Brownfields Development Agreement (BDA) or a Brownfields Voluntary Cleanup Program (VCP) Agreement to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. PROPOSED PLAN OF REMEDIAL ACTION FOR THE J.G. TOWNSEND OU-1 SITE (DE-1338) - The Department invites public comment on a proposal to clean up the J.G. PROPOSED PLAN OF REMEDIAL ACTION FOR THE RAMBLETON ACRES AUTO SERVICE SITE (DE-1470) - The Sire Investigation and Restoration Branch (SIRB) invites public comment on a proposal to clean up of the Rambleton Acres Auto Service Site at 135 Christiana Street in New Castle. The site is the location of two former hydraulic lifts with buried tanks. The site soil was contaminated with Polychlorinated Biphenyls (PCB) and Diesel fuel only at the hydraulic lift area. FINAL PLAN OF REMEDIAL ACTION FOR THE KRIEGER FINGER PROPERTY SITE (DE-1067) - The Site Investigation and Restoration Branch (SIRB) has adopted a plan to clean up the Krieger Finger Property site southeast of the corner of S. Walnut Street and A Street in Wilmington. The 1.5+ acre site is currently a vacant property. AIR QUALITY MANAGEMENT PERMITTING PROGRAM Notice has been given that the facilities listed below have submitted applications for air quality management permits. The applications, the “draft/proposed” permits, all materials that the applicant has submitted (other than those granted confidential treatment under DNREC rules), and a copy of summary of other materials, if any, considered in preparing the “draft/proposed” permit may be inspected at the offices of the Division of Air and Waste Management, 156 S. CODE 1102 APPLICATIONS -  Notice is hereby given that SPI Pharma, Inc. having a facility at 40 Cape Henlopen Drive, Lewes, has requested a federally enforceable 7 DE Admin. Code 1102 construction permit for replacement of the baghouse associated with the Soda Ash silo. 7 DE ADMIN. CODE 1102 NATURAL MINOR PERMIT APPLICATIONS - Berg Corporation requests a permit to construct a portable concrete crusher and screener at 314 Wyoming Road, Newark.  The crusher and screener have the combined annual potential to emit (PTE) 1.44 tons of particulate matter (PM), 2.58 tons of sulfur oxides (SOX), 13.6 tons of nitrogen oxides (NOX), 1.62 tons of carbon monoxide, and 0.83 tons of volatile organic compounds (VOCs).  By Permit# APC-2010/0028-CONSTURCTION, actual annual emissions will not exceed 0.17 tons of PM, 0.30 tons of SOX, 1.55 tons of NOX, 0.19 tons of CO, and 0.10 tons of VOCs.  A public hearing will NOT be held unless the Secretary of DNREC receives a request by September 21, 2009.

TITLE V MODIFICATION APPLICATIONS - Notice is hereby given that Delaware Solid Waste Authority’s Cherry Island Landfill having a facility at 1706 E. 12th Street, Wilmington, has submitted a request for  significant permit modification pursuant to 7 DE Admin.
