NEWS UPDATES:

DNREC’S DART YARD WASTE SITE WILL CLOSE FOR MAINTENANCE AUGUST 31 – SEPTEMBER 9 - DNREC’s DART Mid-County Community Yard Waste Demonstration Site will temporarily close for maintenance activities beginning Monday, August 31 through Wednesday, September 9 and will reopen at 8:30 a.m.,  Thursday, September 10. DNREC’S ENVIRONMENTAL CRIMES UNIT RELEASES ENFORCEMENT STATISTICS FOR FIRST HALF OF 2009; OPEN BURNING VIOLATIONS DECREASE BY 19 PERCENT - DNREC’s Environmental Crimes Unit (ECU) released statistics today for the first six months of 2009 on its investigations into violations of  Delaware environmental laws.  Investigations totaled 2,014, up about 3 percent from the same period in 2008. Illegal open burning, the most frequently made complaint for the past several years, decreased by 19 percent in 2009. DNREC’s Environmental Protection Officers responded to individual complaints that included: 277 water related discharges; 263 open burning; 235 illegal dumping that included 16 arrests;  229 spills; 181 odors; 142 air pollution related releases; 127 permit checks; 96 notifications by industry; 73 vapor recovery checks (from gas stations); 44 asbestos; 26 erosion; 25 facility checks; and 14 wetlands-related issues. More than 140 of the complaints involved DNREC Emergency Response Team (ERT) calls. EPOs and environmental scientists in DNREC’s Emergency Response Branch responded to emergencies that included industrial spills and releases, transportation accidents and other potentially hazardous incidents. In addition, officers apprehended 10 fugitives with active arrest warrants from other police departments. Approximately 38 percent of the complaints were investigated on weekends and after hours. The following is the breakdown this year of the January through June statistics per county:  Total Complaints: 2,014 (New Castle County: 1092, Kent County: 464, Sussex County: 458) Total Enforcement Actions: 127 (New Castle County: 68, Kent County: 33, Sussex County: 26)

RECEIPT OF APPLICATION FOR A COASTAL ZONE PERMIT AND COASTAL ZONE ACT PUBLIC HEARING - DNREC has received an application from MAGCO, Inc. and will conduct a public hearing on September 8, 2009 at the DNREC office building at 391 Lukens Drive beginning at 6:00 p.m.  The company is seeking a Coastal Zone permit to relocate an existing sea salt packaging operation from its current location in the Coastal Zone (6200 Philadelphia Pike, Claymont) to a site located at 341 Pigeon Point Road, New Castle.

UPCOMING AIR AND WASTE-RELATED HEARINGS, MEETINGS & EVENTS:

AMENDMENT TO REGULATION 1138, EMISSION STANDARDS FOR HAZARDOUS AIR POLLUTANTS FOR SOURCE CATEGORIES PUBLIC HEARING - Delaware is proposing to amend Regulation 1138 by adding a new Section 10 that covers facilities that deposit metal coatings onto metal parts or products by either electroplating or electroless coating operations. The new standard also applies to the dry mechanical polishing (or grinding) of these coated parts or products.  The purpose of this proposed amendment to Regulation 1138 is to provide increased protection for Delaware citizens against a variety of potential adverse health effects linked to a long term exposure to cadmium, chromium, lead, manganese, or nickel compounds.  In addition, all of these compounds, except the manganese compounds, are classified as known or probable human carcinogen by the EPA.  This amendment proposes to adopt requirements that are at least as health protective as requirements of the recently promulgated federal standard, as well as, existing requirements found in similar area source standards in Regulation 1138. PUBLIC HEARING REGARDING THE CONSENT DECREE FOR RESPONSE COSTS AND NATURAL RESOURCE DAMAGES FOR FOX POINT STATE PARK SITE (MODIFIED) - The Site Investigation and Restoration Branch (SIRB) has scheduled a public hearing regarding the Consent Decree for the settlement by New Castle County for response costs and natural resource damages for the Fox Point Park Site located in Wilmington. The public hearing will be held on Wednesday, September 16, 2009 at 6.00 p.m. in the library at Bellevue Hall, located at 911 Philadelphia Pike in Wilmington. PUBLIC HEARING REGARDING THE PROPOSED REVISION TO THE STATE IMPLEMENTATION PLAN FOR THE ATTAINMENT AND MAINTENANCE OF THE NATIONAL AMBIENT AIR QUALITY STANDARDS FOR OZONE BY REVISING 7 DE ADMIN CODE 1142 (I.E., REGULATIONS GOVERNING CONTROL OF AIR POLLUTION NO. 1142) SECTION 2.0 – CONTROL OF NOX EMISSIONS FROM INDUSTRIAL BOILERS AND PROCESS HEATERS AT PETROLEUM REFINERIES - The Air Quality Management (AQM) Section will conduct a public hearing on a proposed revision that when finalized, will revise emission limits for 3 boilers in Valero Refinery at Delaware City.  DNREC believes that the new limits are adequate for achieving necessary and timely NOx emission reductions that will aid Delaware attainment of the ozone standards.  The proposed revision aims also at resolving an appeal from Valero Refinery on 7 DE Admin. Code 1142 Section 2 as promulgated in July 2007. BROWNFIELDS DEVELOPMENT PROGRAM The Division’s Brownfields Development Program encourages the cleanup and redevelopment of vacant, abandoned or underutilized properties which may be contaminated. A party seeking to develop such a property negotiates with the Division's Site Investigation and Restoration Branch (SIRB) for a Brownfields Development Agreement (BDA) or a Brownfields Voluntary Cleanup Program (VCP) Agreement to perform an investigation and, if necessary, a remedial action or remedy, for the purpose of addressing the risks posed by past releases of hazardous substances at these sites. PROPOSED PLAN OF REMEDIAL ACTION FOR THE J.G. TOWNSEND OU-1 SITE (DE-1338) - The Department invites public comment on a proposal to clean up the J.G.
