News Updates
Ozone Exceedances in New Castle County – On August 17, the ozone 8-hour standard of 0.08 parts per million (ppm) was exceeded at one air quality monitoring site in Delaware - Summit Bridge in New Castle County. Ozone was detected at a concentration of 0.086 ppm. However, there were no exceedances of the 1-hour standard of 0.12 ppm on this day at Summit Bridge, or at any of the other nine air quality monitoring sites in Delaware.
Over the summer, there were a total of five days with exceedances of the 8-hour standard, and all of the exceedances occurred in New Castle County. However, the 1-hour standard was only exceeded on one of the five days at three air quality monitoring stations located in New Castle County. While maximum ozone readings are usually recorded in June, July, and August, the ozone monitoring season extends through the end of October. Delaware City Refinery Update – The fluid catalytic cracking unit (FCCU) wet gas scrubber (WGS) regenerator stripper reboiler at the refinery was returned to service over the weekend. The reboiler was taken out of service last month for repair of the reboiler’s tube sheet. The reboiler is a component that strips the rich amine off the acid gas so that it can be reused in the absorber. During the return to service, flue gas flow did not bypass either the carbon monoxide boiler or the scrubber train. However, because the amine circulation was stopped for approximately 24 hours, sulfur dioxide emissions increased above the permitted short term level of 50 ppm. The caustic polisher remained in circulation. Valero resumed normal operation following the reboiler's return to service on Saturday evening, Sept. 8.
In addition, there is a planned turnaround of the continuous catalyst regenerator (CCR) reformer, which will last approximately four weeks. No adverse environmental incidents are expected to result from this turnaround activity. September Meetings of the State Emergency Response Commission (SERC) and the Local Emergency Planning Committees (LEPCs) - LEPCs were appointed by the Delaware State Emergency Response Commission. The LEPC provides a forum for interaction and information sharing among businesses, government officials, emergency organizations, and the public. INVISTA S.A.R.L. APPLICATION FOR OPERATION OF INVISTA SEAFORD INDUSTRIAL WASTE LANDFILL

INVISTA S.à.r.l. applied for renewal of the INVISTA Seaford industrial waste landfill permit. INVISTA Seaford, which is currently in operation, is located at 25876 DuPont Road in Seaford. Under the current industrial waste landfill permit, INVISTA disposes of industrial waste (fly and bottom ash) generated onsite, at a 12.25 acre landfill located on the property. INVISTA has not requested any changes in the wastes allowed by the permit or operation of the landfill.

CITY OF WILMINGTON AND DSWA APPLICATION FOR POST-CLOSURE CARE PERMIT FOR THE CLOSED PIGEON POINT LANDFILL IN NEW CASTLE NOTICE START DATE: 08/19/2007 NOTICE END DATE: 09/13/2007
DNREC has received an application for a permit to provide post-closure care for the Pigeon Point Landfill located at 1101 Lambson Lane in New Castle. DNREC will hold a public hearing to receive comments on the proposed application on September 12, 2007, starting at 6:00 PM at the Rose Hill Community Center, 19 Lambson Lane in New Castle (see hearing notice above, in ‘Upcoming Air and Waste-Related Hearings, Meetings & Events’ Section). The permit will implement the current post-closure care requirements of Section 5.K of the Delaware Regulations Governing Solid Waste and will include specific requirements for periodic environmental and geotechnical monitoring of the site; cap maintenance; control of litter, odor and dust; control of access and activities on the site; recordkeeping; and reporting.

FINAL PLANS OF REMEDIAL ACTION FOR OPERABLE UNITS 127, 130 & 132, SAINT GEORGES BRIDGE SITE

SIRB announced the Final Plans of Remedial Action for the St. Georges Bridge Site, Operable Units (OUs) 127, 130 and 132. The Final Plans present DNREC's preferred cleanup alternative for the remediation at the St. Georges Bridge Site in St. Georges, Delaware. DNREC issued previous Final Plans for the site covering OU-1 through OU-126 in June 2005, however, these parcels had not granted access for sampling or remediation until recently and were not part of the original investigation. The U.S. Army Corps of Engineers (USACE)-Philadelphia District constructed the St. Georges Bridge in the early 1940s and currently own and maintain the bridge. Subsequent to the opening of the new SR-1 Bridge, the USACE curtailed painting maintenance on the St. Georges Bridge, resulting in peeling and chipping lead paint that impacted the surrounding neighborhoods.
DNREC invited written comments on the Proposed Plans of Remedial Action. The public comment period for the Proposed Plans began on August 6, 2007, and ended at the close of business (4:30 p.m.) on August 27, 2007. No comments were received. The public may appeal the Final Plans by September 29, 2007. PROPOSED PLAN OF REMEDIAL ACTION FOR THE MILLSBORO TCE GROUNDWATER CONTAMINATION SITE IN MILLSBORO

The Site Investigation and Restoration Branch (SIRB) announced the Proposed Plan of Remedial Action for the Millsboro TCE Groundwater Contamination Site (a/k/a Millsboro Public Well TCE Site). The site is located at the intersection of Wharton Street and S. DuPont Highway and is the source area for the trichloroethylene (TCE) groundwater contamination in the area. The site also includes the TCE recovery area consisting of two (2) public supply wells located at Church Street in Millsboro. The TCE source area property was formerly used for the manufacturing of poultry vaccines between 1952 and August 1999. Previous owners and/or operators of the source area property included: Delaware Poultry Laboratories, Inc., Sterwin Laboratories, Mallinckrodt Veterinary, Inc. and Schering-Plough Animal Health Corporation. The poultry vaccine manufacturing building on the site was demolished in December 1999.

SIRB announced the Proposed Plan of Remedial Action for the 0 Miller Road site. The site is located on "Miller Road", a road that has not been built, but is shown on maps located between Center Street and Pyles Lane in New Castle, Delaware. The site is a 2.3 acre parcel located in the Hamilton Park neighborhood in New Castle. It is currently a vacant, wooded lot that DNREC certified as a Brownfield property. The Crescent Foundry Company owned and operated the site from 1902 to 1910. The site was later filled with various fill materials. Both the foundry operation and the filling activities likely resulted in elevated levels of metals in soil, including arsenic above the Delaware Default Background Standard of 11 parts per million (ppm).

Notice is hereby given that the Dover Air Force Base, at Routes 13 and 10 in Dover, has submitted a request for significant permit modification pursuant to Regulation No. 30, Section 7 for an operating permit. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the USEPA and DNREC. Therefore a "draft" significant permit modification has been prepared. The draft significant permit modification changes the frequency of required fuel oil sampling and sulfur content testing to at least once every three months.

This amendment will not increase emissions. VFL Technology Corporation requests a limit for particulate matter less than 10 microns (PM10). These limits are necessary to restrict VFL Technology Corporation’s potential to emit air pollutants, and the limit will be enforceable by the EPA and the state. This auto body shop has a potential to emit less than 25 tons per year of volatile organic compounds (VOCs). - Bennie Smith Funeral Home requested a permit to construct a crematory at their 717 West Division Street, Dover facility. The crematory has the potential to emit (PTE) 0.35 tons per year of particulate matter (PM). By permit, actual PM emissions will not exceed 0.079 pounds per hour and 0.12 tons per year.
- MCubed Technologies, Inc. requested permits to construct and operate two Donaldson Torit dust collectors at their Newark facility. The maximum controlled PM emissions from the dust collectors are not expected to exceed 0.29 and 0.2 tons per year (TPY) for the two collectors.
- First State Crematory, Inc. requested a permit to construct one pet cremator and one human cremator at their 29814 Lakewood Drive, Millsboro facility. Each cremator has the potential to emit 0.29 TPY PM, 0.02 TPY carbon monoxide (CO), 4.38 TPY nitrogen oxides (NOx), 0.02 TPY volatile organic compounds (VOCs), and 0.67 TPY sulfur oxides (SOx). By permit, actual emissions will not exceed 0.12 TPY PM, 0.01 TPY CO, 1.87 TPY NOx, 0.01 TPY VOCs, and 0.29 TPY SOx per unit.

- DuPont Experimental Station in Wilmington submitted a permit application based on Regulation No. 1102 to construct and operate Boiler #6- 96 mmBTU/hr heat input, with No.6 fuel oil as a primary fuel, equipped with Low NOx Burner and Flue Gas Recirculation Technology. The annual maximum emissions of NOx, SOx, CO, and particulate matter less than 2.5 microns (PM2.5) will not exceed 64.8 TPY, 115 TPY, 7.8 TPH, and 16.8 TPY, respectively. - Sussex County Council requests a permit to construct a 500 kilowatt (kW) emergency generator at their Station #40 facility, located at 33711 South Coastal Lane in Frankford. The generator has the potential to emit 1.76 TPY of combined VOC and NOx, 0.97 TPY CO, 0.06 TPY SOx, and 0.06 TPY PM, based on 500 hours of operation per year.
- Sussex County Council also requests a permit to operate a 600 kW emergency generator at their Emergency Operations Center, located at 21518 Rudder Lane in Georgetown. The emergency generator has the potential to emit 2.12 TPY of combined VOC and NOx, 1.16 TPY CO, 0.07 TPY SOx, and 0.07 TPY PM, based on 500 hours of operation per year.

Congratulations to Jim Short, who was hired as an Environmental Scientist IV, with the Solid and Hazardous Waste Management Branch (SHWMB), effective September 2, 2007. Jim was formerly an Environmental Project Manager I with SHWMB. Congratulations also to Aaron Siegel and Elizabeth Wolff, who were both hired as Hydrologists I with the Tank Management Branch, effective September 4, 2007. In addition, congratulations to John Cargill in the Site Investigation and Restoration Branch, who was recently reclassified from an Environmental Scientist III to a Hydrologist III.
Many congratulations also to the following employees who are celebrating their anniversaries with the Division in September: Paula Moore (5 years) with Accounting; and Bob Clausen (5 years), Brad Klotz (10 years) and David Fees (15 years), all with the Air Quality Management Section.
