DNREC Adopts New Regulations to Substantially Reduce Air Emissions from Power Plants – DNREC Secretary Hughes signed an order on November 16, 2006 adopting a new regulation that will require air emissions reductions from the state’s eight largest electrical generating units that burn coal or residual oil. The regulation will require reductions of mercury emissions of more than 80 percent, and will reduce allowable sulfur dioxide by 87 percent and nitrogen oxides by 76 percent by 2012. These reductions are a major component of Delaware’s plan to meet federal air quality standards by 2010. Units that will be regulated are NRG’s Indian River power plant, three units at Conectiv’s Edge Moor plant and the City of Dover’s largest unit at the McKeen Run plant. The Indian River power plant is the State’s largest source of toxic releases to the environment with the Edge Moor power plants ranking second. Upcoming Air and Waste-Related Hearings, Meetings & Events
November 21 – Yard Waste Meeting at Civic League for New Castle County will be held at 7:00 PM at Keene Elementary School, located at 200 Lagrange Ave. in Newark. DNREC’s Division of Air and Waste Management is working with the Delaware Solid Waste Authority to present information on the Cherry Island Landfill yard waste ban effective January 1 and the options available for homeowners. December 4 – Public Hearing on Amendment to Regulation 1124 - Control of Volatile Organic Compound Emissions will be held at 6:00 PM at the DNREC Auditorium, Richardson and Robbins Building, located at 89 Kings Highway in Dover. The public hearing is on a proposed amendment to Regulation No. 1124 - adding a new Section No. 46, Crude Oil Lightering Operations. The proposed amendment will help to control the emissions of volatile organic compounds and hazardous air pollutants from crude oil lightering operations that occur in the waters of the State. Lightering is the process where the draft of large ocean going vessels is reduced by bulk transfer of cargo from the ocean-going vessels to smaller service vessels. This reduction in draft is necessary for the ocean-going vessel to be able to proceed upriver.
Interested parties may submit comments in writing on this proposed amendment prior to the public hearing, and/or comments may be presented either orally or in writing at the public hearing. December Workshops on Recycling Assistance Grant Program – Now Accepting Applications for 2007. The application deadline is January 31, 2007. A total of $50,000 in grant funding is available in for Delawareans to develop or expand innovative waste reduction, reuse, and/or recycling projects tailored to community needs. Grant awards will be announced in March 2007, and projects must be completed by May 2008. Public information workshops on the Recycling Assistance Grant Program will be held at the following times and locations:

INEOS Films Inc. has submitted construction permit applications for two (2) Calender Systems. Total volatile organic compound (VOC) emissions will not exceed 5.0 tons per year. Also, total particulate matter (PM) emissions will not exceed 3.0 tons per year. In addition, INEOS Films Inc. submitted a construction permit application for a Storage Silo. PM emissions will not exceed 0.04 ton per year.

REGULATION 1102 NATURAL MINOR PERMIT APPLICATION FOR STONETECH, LLC IN KENT OR SUSSEX COUNTY

Stonetech, LLC, is requesting a Regulation No. 1102 permit to construct a portable crushing plant at one of the following Pennsy Supply, Inc. dba Tilcon, Delaware locations: 3700 Bay Road, Dover, Kent County, Route 113 South near County Route 323, Georgetown, Sussex County and 20139 Lowes Road, Millsboro, Sussex County. The portable crushing plant has the potential to emit 23 tons per year of nitrogen oxides (NOx), 4.7 tons per year of sulfur oxides (SOx), 3.6 tons per year carbon monoxide (CO), 0.85 tons per year volatile organic compounds (VOCs) and 28 tons per year particulate matter (PM). By Permit# 20070058, actual emissions will not exceed 4.7 tons per year NOx, 0.96 tons per year SOx, 0.73 tons per year CO, 0.18 tons per year VOCs and 5.0 tons per year PM.

NOTIFICATION OF PUBLIC COMMENT PERIOD REGARDING THE SIGNING OF A BROWNFIELDS DEVELOPMENT AGREEMENT (BDA) FOR THE DELAWARE HUMANE SOCIETY SITE IN WILMINGTON

DNREC's Site Investigation and Restoration Branch (DNREC-SIRB) negotiated a BDA with SouthBank Associates, LLC for the Delaware Humane Society site, located at 701A Street in Wilmington, Delaware. The site is currently owned by the Delaware Humane Society and may contain hazardous substances as a result of its past industrial use.
DNREC invites written public comments on this BDA. The public comment period began on November 15, 2006 and will close at the end of the business day (4:30 PM) on December 5, 2006. TITLE V SYNTHETIC MINOR PERMIT APPLICATION FOR PURE GREEN INDUSTRIES, INC. IN WILMINGTON

Pure Green Industries, Inc. has submitted an application, pursuant to Regulation No. 1102, for a permit amendment to construct a used oil burner system to supply a 75-ton per hour batch hot mix asphalt plant at 1620 Bowers Street, Wilmington, Delaware.

TITLE V PERMIT MODIFICATION APPLICATION FOR DUPONT TITANIUM TECHNOLOGIES IN EDGE MOOR

The Division’s Air Quality Management Section has given notice that DuPont Titanium Technologies, having a facility at 104 Hay Road, Edge Moor, Delaware, has submitted a request for a significant permit modification pursuant to Regulation No. 30 for their operating permit. Based on the data and certifications contained in the application, the Air Quality Management Section concludes that the applicant meets all applicable requirements promulgated by the EPA and DNREC. Therefore a "draft" significant permit modification has been prepared. The draft significant permit modification revises the procedures for monitoring emissions from the process start-up stack and removes opacity limits during the startup and shutdown of the condenser/chlorinator train.

FINAL PLAN OF REMEDIAL ACTION FOR THE JUSTISON REDEVELOPMENT PROJECT-PHASE II IN WILMINGTON

The Division’s Site Investigation and Restoration Branch (SIRB) has adopts the proposed plan of remedial action as the final plan of remedial action for the Justison Redevelopment Project –Phase II. The site is located on 221 and 300 South Madison Street in Wilmington, Delaware. The site is approximately 10.9 acres in size, and is made up primarily of the former Wilmington Coal Gas Site – North, and a portion of the Wilmington Public Works Yard, referred to as the “triangle parcel.” The site is located in an area that has been in continuous industrial use since the late 1800s, and has been impacted with hazardous substances.
The proposed and final plans are available at the Wilmington Public Library or at the office of DNREC–SIRB, 391 Lukens Drive, New Castle, DE 19720. The Proposed Plan and Final Plan are also posted on DNREC-SIRB’s website at http://sirb.awm.dnrec.state.de.us under the subject “Announcements.” DNREC invited comments on the proposed plan, however, none were received. The public may appeal the final plan by November 21, 2006. New Faces/New Places
Please welcome Mark Lyon as an Environmental Compliance Specialist in Solid and Hazardous Waste Management Branch (SHWMB), effective November 27. Also in the SHWMB, congratulations to Melissa McAllister, who will be promoted to Engineer II, effective November 26.
Following Ray Malenfant’s retirement this fall, Phil Wheeler is acting as Environmental Program Manager II in the Air Quality Management Planning Branch. Also, welcome back to John Esch, who was reinstated as a Senior Boiler Safety Inspector in the Boiler Safety Division on November 13.
