The following programs are administered by the Air Quality Management Section unless otherwise noted.
Asbestos – The abatement/renovation program regulates the removal and disposal of asbestos in the state. Contact Valerie Gray at (302) 739-9402 for additional information.
Air Permit Tracking – A searchable database of all current applications for air permits in Delaware. Information in the database includes the name of the company applying for the permit, the permit type, what the permit is for, date of the public notice and hearing, and the data the permit was issued. Air Body Self-Certification Program – Administered by the Department’s Small Business Assistance Program, the Auto Body Self-Certification Program is a voluntary opportunity for auto body shops in Delaware to identify which environmental requirements apply to their shop and to commit to fixing any problems so they fully comply with the law. Coastal Zone Program - This program helps to preserve and protect the state’s coastal resources and resolve conflicts related to coastal zone issues. A Coastal Zone permit may be required for new facilities or for modifications to existing facilities within the Coastal Zone. A Coastal Zone permit or determination is required before the Air Quality Management Section can process any permit application for a facility within the Coastal Zone. Electric Generating Unit (EGU) Multi-Pollutant Regulation - This regulation is specifically designed to reduce air emission from Delaware’s coal- and residual oil-fired power plants. The reason for the new regulation is to protect public health, safety, and welfare from pollutants which include nitrogen oxides (NOx), sulfur oxides (SOx), and mercury. Emission Inventory – Since Delaware has not yet been able to meet air quality standards for Ozone, the State is required under the Clean Air Act to submit a comprehensive, accurate, current inventory of actual emissions of ozone precursors from all sources every three years, starting in 1993. Ozone precursors, or air pollutants that form ozone, are volatile organic compounds (VOCs), oxides of nitrogen (NO x), and carbon monoxide (CO). Facilities emitting these and other pollutants are required to submit their emissions annually under Air Regulation No. 17, Section 7. Contact David Fees at (302) 739-9402 for additional information.
Motor Vehicle Inspection and Maintenance Program – In Delaware, Motor vehicle emissions tests are performed on all light-duty vehicle weighing up to 8,500 pounds gross vehicle weight at the Delaware Division of Motor Vehicles. Contact Valerie Gray at (302) 739-9402 for additional information.
Natural Minor and Synthetic Minor Permitting - Included in this link are Regulation No. 1102 permit application forms for all Natural Minor and Synthetic Minor permit applicants and customized application forms for auto body shops, dry cleaners, gasoline dispensing facilities, gasoline tank trucks (delivery vessel) operators, and air stripping/soil venting operations. Open Burning - Open burning restrictions are in effect in all three Delaware counties from May 1-Sept. 30. Additional burning bans may be established from October through April by the State Fire Marshall. Contact Valerie Gray at (302) 739-9402 for additional information.

Small Business Technical Assistance Program - A Small Business Assistance Ombudsman is available through the Department’s Office of the Secretary to help small businesses understand and comply with the requirements of the Clean Air Act. Title V Permitting - All Title V permit applications can be reached via this link. Title V is a federal program designed to standardize air quality permits and the permitting process for major sources of emissions across the country. The name "Title V" comes from Title V of the 1990 federal Clean Air Act Amendments which required that the Environmental Protection Agency (EPA) establish a national operating permit program. Title V only applies to "major sources." EPA defines a major source as a facility that emits, or has the potential to emit (PTE) any criteria pollutant or hazardous air pollutant (HAP) at levels equal to or greater than the Major Source Thresholds (MST). The MST for criteria pollutants may vary depending on the attainment status (e.g. severe, serious, extreme) of the geographic area and the Criteria Pollutant or HAP in which the facility is located. Truck Anti-Idling - Vehicles that weigh over 8,500 pounds gross vehicle weight are restricted to engine idling time of no more than three minutes. Contact Phil Wheeler at (302) 739-9402 for additional information.
Vapor Recovery - This program is administered by the Department’s Tank Management Branch. All tanks that dispense gasoline and other petroleum products are required to have vapor recovery systems. Contact Pete Rollo at (302) 395-2500 for additional information.
